Direito e incoerência

Todos sabemos que a grande maioria das pessoas com deficiência (principalmente, os deficientes físicos) precise de algum tratamento terapêutico para melhorar a sua condição de vida. Eu, por exemplo, faço fisioterapia e natação (http://blogdaacessibilidade.blogspot.com.br/2012/10/o-paradesporto-no-ipa-esta-voltando.html). Sou servidor público estadual e tem uma lei aqui no Rio Grande do Sul (Lei Estadual 13.320, de 21 de dezembro de 2009) que consolida os direitos da PcD no estado.
A lei é bem clara quando fala dos direitos dos servidores públicos estaduais que tenham filhos com deficiência. Diz a lei: "CAPÍTULO VII- DOS SERVIDORES PÚBLICOS-Art. 112 - Os servidores públicos estaduais da administração direta, autárquica ou fundacional, incluindo os empregados das fundações mantidas ou instituídas pelo Estado, que possuam filho, dependente, com deficiência congênita ou adquirida, com qualquer idade, terão sua carga horária semanal reduzida à metade, nos termos desta Seção.
§ 1º - A redução de carga horária, de que trata o “caput”, destina-se ao acompanhamento do filho, natural ou adotivo, no seu tratamento e/ou atendimento às suas necessidades básicas diárias".
Mais claro, impossível e acho justo e perfeito. Os pais tem que ter um tempo extra para cuidar do seu filho deficiente.
Agora, a referida lei não tem o mesmo cuidado para o servidor público que tenha deficiência. Veja o que ela diz a respeito disso também no capítulo VII: "Art. 110 - A pessoa com deficiência será preferencialmente lotada em órgão cuja infraestrutura lhe facilite o acesso ao local de trabalho e desempenho da função, desde que verificada a necessidade administrativa de lotação do respectivo cargo". Isso é o máximo a favor que esta lei oferece a PcD que é servidor público no Rio Grande do Sul. Ela não dá nenhum auxílio a quem precise de algum tipo de tratamento terapêutico para melhorar a sua condição de vida.
Pior ainda é a situação dos servidores federais. Segundo a minha amiga e grande admiradora deste blog, Patricia Picon, que trabalha no Tribunal Regional Federal, eles não têm direito a um horário especial para cuidar dos seus filhos com deficiência. Ela tem uma filha deficiente (que eu tive o prazer de conhecer e achei uma graça) e precisou contratar uma profissional para cuidar da menina.
Parece que quem faz as leis, não se preocupa com todos. Ou, simplesmente, não se tem direito nenhum como acontece com os servidores públicos federais.
